Terms of service

These terms govern use of the Soba service and the usesoba.com website, provided by Project Peach Inc. ("Soba", "we"). By using the service you agree to them.

The service

Soba answers calls and texts on a customer's behalf, takes order requests, applies the price rules the customer sets, relays requests to the customer's reps, and sends callbacks, confirmations and summaries. Soba acts only on instructions given by the customer or by price rules the customer set.

Customer responsibilities

• You are responsible for the prices, volumes and settings you give Soba, and for the orders confirmed under them.
• You are responsible for forwarding your phone line correctly and for the accuracy of your team's contact details.
• You confirm that your reps have agreed to receive WhatsApp and text messages from Soba.
• You will use the service lawfully and not for spam, harassment or any purpose other than taking and confirming orders for your business.

Confirmations are interim

A confirmation sent by Soba records what was agreed on the call or text. It is not an invoice, bill of lading or contract of sale. The customer's own order documents govern.

Availability

We aim for the service to run every night, but telephony, messaging and voice providers can fail. When Soba cannot answer, calls fall back to the backup number you set. We are not liable for orders missed during an outage.

Fees

Fees are set out in your order form or pilot agreement. Pilots are free unless agreed otherwise in writing.

Data

Our privacy policy explains what we collect and how we use it. Conversation records belong to the customer and are returned or deleted at the end of the engagement on request.

Limitation of liability

To the extent permitted by law, Soba's total liability under these terms is limited to the fees paid in the three months before the claim, and we are not liable for indirect or consequential loss, including lost sales.

Termination

Either party may end the service with 30 days' notice. We may suspend the service immediately for misuse.

Governing law

These terms are governed by the laws of the State of Delaware.
